This Website Privacy Statement and Disclaimer applies to this website, operated by The Australian Council on Healthcare Standards (ACHS) International ("ACHS International") under the domain name "www.achsi.org". It explains the personal information that ACHS, the parent company to ACHS International, and its subsidiaries may collect when you use this website, how ACHS may use and/or disclose that information and the procedures that ACHS has in place to safeguard your privacy.

Collection of Information

ACHS International collects certain standard information that your browser sends to the ACHS International website when you visit it.   • you would reasonably expect that the personal information would be used or disclosed for direct marketing;
  • ACHS International has provided a simple means by which you can request not to receive direct marketing; and
  • you have not made such a request.

Where you would not reasonably expect your personal information to be used for direct marketing, or the information has been collected from a third party, ACHS International may only use or disclose personal information if:
  • you have consented to the use or disclosure for this purpose or it is impracticable to obtain your consent;
  • ACHS will provide a simple means by which you can opt out; and
  • in each direct marketing communication ACHS International will include a prominent statement telling you that you may request to no longer receive marketing, and no such request has been made.

You have the right to contact ACHS International to:

ACHS International does not need to comply with requests to disclose the source of information if it is impracticable or unreasonable to do so. If ACHS International is required or authorised to use or disclose your personal information for a purpose other than the primary purpose for which it was collected, ACHS International will take steps to inform you of the other use or disclosure (unless ACHS International is prevented by law from doing so).

Under no circumstances will ACHS International sell or trade your personal information.

If ACHS International obtains your email address as a result of you sending an email to ACHS International, the email address will not be used or disclosed for a purpose other than the purpose for which it was provided. ACHS International will not add your email address to an email distribution list without your consent.

Access to Personal Information

The ACHS International website allows you to access all of the personal information you have voluntarily provided to ACHS International during your use of this website. If for any reason you are unable to access your personal information, you have the right to request a copy of the personal information about you held by ACHS International.

ACHS International will consider and respond to requests from you for access to the personal information about you held by ACHS International within a reasonable period after the request is made, and in a manner requested by you (if it is reasonable and practical to do so). If ACHS International charges you for giving access to the personal information, the charges will not be excessive, and the charges will not apply to the making of the request. ACHS International will only decline an access request in certain limited circumstances prescribed by the Privacy Act. These include, amongst others, where:
  • providing access would have an unreasonable impact upon the privacy of other individuals;
  • the request for access is frivolous or vexatious;
  • providing access would be unlawful;
  • denying access is required or authorised by or under an Australian law or court / tribunal order; or
  • both of the following apply:
    • ACHS International has reason to suspect that unlawful activity, or misconduct of a serious nature, that relates to its functions or activities has been, is being or may be engaged in; and
    • giving access would be likely to prejudice the taking of appropriate action in relation to the matter.

If ACHS International denies a request for access to the personal information or for access in the manner requested, ACHS International will take such steps (if any) as are reasonable in the circumstances to give access in a way that meets the needs of both ACHS International and you, including giving access through a mutually agreed intermediary.

ACHS International will provide you with written notice if it refuses to give access to the personal information or to give access in the manner requested by you. The written notice will set out:
  • the reasons for the refusal except to the extent that, having regard to the grounds for refusal, it would be unreasonable to do so; and
  • the mechanisms available to complain about the refusal.

Correction of Personal Information

ACHS International will take reasonable steps to ensure that any personal information about you it holds is accurate, complete and up to date as well as relevant, having regard to the purpose of that disclosure or use.

The ACHS International website also allows you to edit all the personal information you have voluntarily provided to ACHS International during your use of this website.

If for any reason you are unable to edit your personal information, you have the right to request that ACHS International adds to, corrects or updates your personal information. If:
  • ACHS is satisfied that, having regard to a purpose for which the information is held, the information is inaccurate, out-of-date, incomplete or irrelevant or misleading; or
  • you are the individual to whom the personal information relates, and you request ACHS to correct the information,
then ACHS International will take reasonable steps to correct the personal information to ensure that, having regard to the purpose for which it is held, it is accurate, up-to-date, complete, relevant and not misleading.

If ACHS International corrects personal information about you that it has previously disclosed to a third party and you request ACHS International to notify that third party of the correction, ACHS International must take such steps as are reasonable in the circumstances to notify the other party of the correction, unless it is impracticable or unlawful to do so. ACHS International will provide you with written notice if it refuses to correct the personal information as requested by you. The written notice will set out:
  • the reasons for the refusal except to the extent that it would be unreasonable to do so; and
  • the mechanisms available to complain about the refusal.

Security of Personal Information

ACHS International will take all reasonable steps to protect the personal information it holds from misuse, interference and loss and from unauthorised access, modification, or disclosure.

ACHS International will take all reasonable steps to destroy or permanently de-identify personal information if the personal information is no longer required for any purpose for which it may be used or disclosed in accordance with the APPs if ACHS International is not required by or under Australian law, or court / tribunal order, to retain the information.

You are responsible at all times for maintaining the confidentiality of your ACHS International website account username and password (if you have registered with the ACHS International website).

Cookies

A "cookie" is a small data file which is stored on your hard drive or in your computer's memory when you visit a website. Cookies are generated by web servers when you access a website and are passed to your computer and stored for subsequent future use.

Some interrupted session information (for example, "shopping cart" content) will be saved for a period of time determined by the ACHS International website system administrators (this is usually around 20 days).

Credit Card and Financial Information
